Welcome to The Rock Collective (“TRC”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). By using the Services, you agree to these Terms and to our Privacy Policy.

1) Eligibility & Account

• You must be at least 13 years old (or the age of digital consent in your region). If you are under 18, you may use the Services only with a parent/guardian.
• You’re responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2) Orders, Payment & Availability

• Placing an order is an offer to buy; we may accept or reject at our discretion (e.g., suspected fraud, pricing/stock errors).
• Prices, shipping rates, and taxes are shown at checkout and may vary by region. You authorize us to charge your selected payment method for all amounts due.
• We reserve the right to limit quantities and discontinue products at any time.

3) Preorders, Custom & Made-to-Order Items

Custom/made-to-order items may require up to 15 days to process before shipping and are generally final sale unless defective on arrival. Estimated dates are not guarantees.

4) Shipping & Risk of Loss

• Title and risk of loss pass to you upon carrier acceptance. Delivery dates are estimates and may be affected by carrier delays or customs.
• International customers are responsible for duties/taxes and compliance with local import laws.

5) Returns & Refunds

Our return rules are described in the Returns & Refunds Policy. In short: eligible items returned on time and in original condition are typically refunded as store credit (Rock Dollars). Original shipping is non-refundable unless we made an error.

6) Promotions, Gift Cards & Rock Dollars

• Promotions/coupons are single-use, non-transferable, and may have minimums, exclusions, or expiry dates. We may modify or cancel a promo at any time.
• Gift cards and store credits are not redeemable for cash (except where required by law) and cannot be replaced if lost or stolen—treat them like cash.

7) Content & Intellectual Property

• All site content—including designs, graphics, logos, product images, text, and code—is owned by TRC or our licensors and protected by IP laws. You may not reproduce, distribute, or create derivative works without written permission.
• If you submit content (e.g., reviews, photos), you grant TRC a worldwide, royalty-free license to use, reproduce, modify, and display that content in connection with the Services and marketing, in any media, with or without attribution, consistent with our Privacy Policy.

8) Acceptable Use

You agree not to misuse the Services, including by: violating laws or third-party rights; attempting to access non-public areas; interfering with security or operations; scraping without permission; posting unlawful, infringing, defamatory, obscene, or hateful content; or using the Services to send spam or malware.

9) Third-Party Services & Links

We may link to third-party sites or use third-party apps (payments, shipping, analytics). We don’t control those services and aren’t responsible for their content or practices. Your use of them is at your own risk and governed by their terms/policies.

10) Disclaimer of Warranties

To the fullest extent permitted by law, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, and non-infringement). Some jurisdictions don’t allow limits on implied warranties; these may not apply to you.

11) Limitation of Liability

To the fullest extent permitted by law, TRC and our officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits/revenue/data, arising from or related to your use of the Services or products. Our total liability for any claim will not exceed the amount you paid to TRC for the product or $100, whichever is greater. Some jurisdictions don’t allow certain limitations; these may not apply to you.

12) Indemnification

You agree to indemnify and hold TRC harmless from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

13) Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Nevada, without regard to conflicts of law principles. You consent to exclusive jurisdiction and venue in the state and federal courts located in Nevada for any disputes not subject to informal resolution. You and TRC agree to first attempt to resolve any dispute informally by contacting [email protected] before filing a claim.

14) Changes to the Services or Terms

We may update these Terms from time to time. Changes are effective when posted. Your continued use of the Services after changes post constitutes acceptance.
